State v. Raatz

Defendant pleaded no contest to criminal mischief, a Class IV felony. After a hearing, the district court sentenced Defendant to a term of imprisonment of twenty to forty months. Defendant appealed, arguing that the district court (1) erred by failing to retroactively apply statutory amendments from 2015 Neb. Laws, L.B. 605, and (2) abused its discretion by sentencing him to a term of incarceration rather than a term of probation. The Supreme Court affirmed, holding (1) the changes set forth by L.B. 605 did not apply to Defendant; and (2) the district court did not err in sentencing Defendant to a term of imprisonment.
